How Section 8 Operates in California

California Department of Housing and Community Development (HCD) & CalHFA

California administers affordable housing finance, state tax credits, and statewide housing accountability through HCD and CalHFA. Section 8 Housing Choice Vouchers are operated by county and municipal housing authorities across all 58 counties.

⚖️

Source of Income Protections & Tenant Rights

Under California Senate Bill 329 (SB 329) and the Fair Employment and Housing Act (FEHA), it is illegal for California landlords or property managers to discriminate against applicants based on their source of income, including Section 8 vouchers. Landlords cannot publish "No Section 8" advertisements or refuse to accept voucher holders who meet standard credit and tenant qualifications.

📊

Fair Market Rents & Voucher Payment Standards

Due to extreme housing costs across coastal and urban areas, many California housing authorities utilize Small Area Fair Market Rents (SAFMRs) or Moving to Work (MTW) exception payment standards, allowing voucher subsidies to reach up to 120%–150% of county FMR in high-opportunity neighborhoods.

Without extra HUD approval, a payment standard is usually any amount from 90% up to 110% of the published Fair Market Rent for that unit size (24 CFR 982.503). Enter your PHA’s written dollar amount in the calculator; otherwise we use 100% of FMR as a stand-in.

Frequently Asked Questions About Section 8 in California

Can landlords in California refuse to accept Section 8 vouchers?

No. California Senate Bill 329 (effective January 2020) amended the state Fair Employment and Housing Act (FEHA) to define housing vouchers as a protected source of income. Landlords cannot refuse to rent to a tenant solely because they hold a Section 8 voucher, nor can they advertise "No Section 8".

How is Section 8 tenant rent calculated in California?

In California, voucher holders pay the higher of 30% of their adjusted monthly income or 10% of gross monthly income (or a minimal PHA fee, typically $50). If the unit rent exceeds the local PHA payment standard, the tenant pays the difference, provided total rent and utilities do not exceed 40% of adjusted monthly income at initial move-in.

How do waiting lists work in California?

Because demand is extremely high, most California PHAs open waiting lists periodically via computer lotteries. Families may apply to multiple open waiting lists across different cities and counties simultaneously to increase their chances of selection.
